Judge asks rapist: 'How would you feel if your sister was a victim?'

MUAR: "You have a younger sister... how would you feel if someone did the same thing (rape) to her? How would you feel as an elder brother?"

This was what a Sessions Court judge said to an 18-year-old who had pleaded guilty to a charge of raping an underage acquaintance today.

"If we don't want bad things to happen our family, then we should not do such things to others. This sentence is not the end, but a lesson for you in the future," said the judge, Abu Bakar Manat.

He later sentenced Muhammad Irfan Mohamad Farid to five years' jail, beginning from the date of his arrest, on Oct 24, and three lashes of the cane.

Irfan, who was not represented, had been charged with raping a 14-year-old girl at a house in Kluang, near here, between 9am and 10am on Oct 22.

The charge was framed under Section 376 of the Penal Code which carries a prison sentence of up to 20 years and whipping.

According to the facts of the case, the victim, who is from Klang in Selangor, had gone to the house after getting to know Irfan through social media.

She had taken a bus ride and spent the night at the house and this was when she was raped by the accused.

Deputy public prosecutor Danial Munir asked for an appropriate sentence, especially taking into account the age of the victim.

"From the facts of the case, the prosecution finds that there was elements of force used against the victims. In fact, the victim has admitted to his wrongdoing and this is a serious matter.

"The incident had left the victim traumatised," he said.

Following proceedings, as Irfan was taken out of court, he was met by his father.

Irfan's police escorts allowed father and son to have a few words before they had a brief hug.

Both were seen wiping away tears before Irfan was led away, to serve his sentence at the Sungai Udang prison in Melaka.
