KUALA KANGSAR: Six men including five siblings were charged at the Sessions Court here today with gang raping and committing sexual physical assault on an 11-year-old girl, last month.
Muhammad Amirul Anuar Zulkifli, 23 and his two brothers aged 14 and 17 as well as his 16-year-old friend however pleaded not guilty when the charge was jointly read to them before Judge, Rohaida Ishak.
According to the charge sheet, they were raping an 11-year-old girl in a room of a house in Kampung Pahat Luar, Gerik early last month.
The offence falls under Section 375B of the Penal Code which carries a prison sentence of not less than 10 years and not more than 30 years, upon conviction.
Meanwhile, another two siblings, Muhamad Akmal Zulkifli, 25 and Muhamad Azuan Zulkifli, 33 pleaded guilty to the charge of committing physical sexual assault on the same victim.
According to the charge sheet, the duo were found to have committed sexual physical assault by sexual means by touching the same victim's breast.
The offence was allegedly committed in the same month and venue.
The offence falls under Section 14 (a) and Section 14 (b) of the Sexual Offenses Against Children Act 2017 (Act 792) which carries up to 20 year's jail and whipping.
Deputy Public Prosecutor Muhammad Firdaus Nor Azlan prosecuted, while all the accused were not represented.
Muhammad Firdaus offered bail of RM5,000 for each accused with one surety and also requested an additional condition that all the accused are prohibited from approaching or disturbing the victim. They must report to the nearest police station once a month until the case is solved.
The judge then set bail of RM4,000 for each accused with one surety and allowed additional conditions as requested by Muhammad Firdaus.
Rohaida also set Jan 22 for mention pending the victim's psychiatrist report, appointing a lawyer, in addition to sentencing the two accused who pleaded guilty to sexual physical assault offences.
It was reported that police had arrested seven men including six siblings for allegedly raping the girl on Nov 21.
Based on initial investigation, a 36-year-old woman who is also the mother of the victim was told by her husband that their 11-year-old daughter had been raped.
The gang rape incident was also witnessed by their nine-year-old son.
Further investigation showed that on Nov 3, at about 2pm, the boy saw seven friends of his elder brother taking turns raping his sister in a room at his neighbour's house.
