Nude couple in toll plaza's surau faces up to six months' jail [NSTTV]

BATU PAHAT: A couple was sent to jail for up to six months at Magistrate Court here for the charge of nudity at a toll plaza's surau near Yong Peng, here, last Wednesday.

Both Lok Kah Hui, 25, and Yap Win Yin, 26, pleaded guilty after the charges were read together in Mandarin by an interpreter in front of Magistrate Suhaila Shafi'uddin.

Kah Hui, who works as a durian orchard keeper, and Win Yin, a pet food shop worker, were accused of stripping each other at a men's prayer hall, near the Yong Peng Toll Plaza at 8.15am, on Nov 8.

They were charged with committing the offense according to Section 377D of the Penal Code which can be punished according to Section 34 of the same Code which carries imprisonment for up to two years if convicted.

Deputy Public Prosecutor Farah Wahidah Mohd Sharip prosecuted both the accused were represented by National Legal Aid Foundation (YBGK) lawyers Tan Song Yan and Kamarul Arifin Nordin.

Earlier, the prosecution, in its argument, asked the court to impose an appropriate sentence by taking the serious offense committed by the two accused.

"Although the two accused plead guilty and save court costs, it does not mean that the plea can automatically lighten the sentence against them.

"The court needs to take into account the public interest for the act of the accused which is extreme obscenity and the punishment needs to be done as a lesson to other individuals," she said.

After taking into account the guilty pleas of the two accused, the arguments of the prosecution and the defense, the court sentenced Kah Hui to six months in prison while Win Yin to five months.

The court also ruled that the sentence would run from the date the two accused were arrested on Nov 8.
