Hindraf fails in bid to challenge deregistration

KUALA LUMPUR: The Hindu Rights Action Force (Hindraf) has failed to challenge the deregistration of the group by the Registrar of Societies' (RoS).

High Court judge Datuk Amarjeet Singh dismissed Hindraf's judicial review application against RoS and the home minister as respondents.

Senior federal counsel Liew Horng Bin, who appeared for the respondents, and counsel Annou Xavier who represented the applicant, confirmed this when contacted today.

Liew said the court also awarded costs of RM5,000 to be paid to the respondents.

In December 2020, the group, through its officer bearer and former minister in the prime minister's department, P. Waytha Moorthy, filed the leave application challenging the validity of two decisions related to the deregistration of the organisation.

The first was a decision by the RoS director-general on Sept 30, 2019 to deregister the group; while the second was against a decision by the Home Minister on Aug 7 last year to uphold the earlier decision.

Hindraf was seeking a declaration that the two decisions to de-register it are illegal and thus null and void; and an order to temporarily suspend the two decisions, pending disposal of the judicial review application.
