No need for by-election in Nenggiri: EC

PUTRAJAYA: No by-election will be held to fill the vacant Nenggiri state assembly seat in Kelantan.

Election Commission (EC) member Datuk Md Yusop Mansor said the decision was made in line with the provisions of the Constitution Law of Kelantan Government.

He said on July 13, the EC had received a formal letter from Kelantan State Assembly Speaker Datuk Abdullah Ya'kob regarding the vacancy of the Nenggiri state seat after its Barisan Nasional assemblyman Datuk Mat Yusoff Abd Ghani has been diqualified on July 11.

Under the Article 46 (5) of Constitution Law of Kelantan Government, any unexpected vacancy for assembly seat could not be filled within two years before the mandate given to the state government expires, unless the speaker notifies in written form to EC on the need to fill the vacancy.

"Based on the notification letter, the Speaker did not mention the need to fill the seat.

"This is also in view with the mandate of the Kelantan State Legislative Assembly in the 13th General Election which exceeds three years.

"So the EC has decided that there will be no by-election in Nengirri," he said in a statement, today.

On June 1, Abdullah has declared the Nenggiri seat vacant as Mat Yusoff has been declared a bankrupt.
