Remand revision rejected, Shafie remain in MACC custody for probe

KOTA KINABALU: The High Court here has dismissed a revision on a remand order against Datuk Seri Mohd Shafie Apdal.

Judicial commissioner Ismail Brahim rejected the application for the review filed by the legal team representing the Parti Warisan Sabah (Warisan) president.

"I disagree with the submission and therefore I dismiss (the review application)," he said after hearing arguments from the counsels and Malaysian Anti-Corruption Commission (MACC) .

During the hearing, counsel Hamid Ismail argued the MACC could not use Section 117 of the Criminal Procedure Code to detain a person for the purpose of completing an investigation.

"Detaining a person (under CPC) is a breach of one's personal liability.

"Secondly, the ground of application for remand is not valid in law because the purpose is to interrogate (Shafie).

"Those application should have been refused in the first place," he told reporters when met outside the court.

Meanwhile, MACC deputy public prosecution Rustam Anip stressed the CPC applies to the commission as stated under Section 3 of the CPC.

Shafie is scheduled to be brought to the magistrate's court for extension remand later.

Earlier, Shafie's younger brother Datuk Mohd Yusof Apdal was realesed on RM100,000 MACC bail before Magistrate Cindy Mc Juce Balitus.

They were among 13 people detained by MACC to assist in the ongoing probe over misappropriation of federal funds meant for Sabah rural development projects.
