Malaysian NGO to submit evidence to ICC against Israeli war crimes

KUALA LUMPUR: A Malaysian non-governmental organisation is determined to submit a report and evidence of the ongoing war crime committed by Israel on the Palestinian people to the International Criminal Court (ICC) prosecutor's office.

MyAQSA Foundation (MyAQSA) co-chair of the legal team Lukman Sheriff Alias said the organisation is resolute in its efforts to bring Israel and other involved parties to the ICC.

He said they have collaborated with the Palestinian government and the Palestinian Embassy in Malaysia to ensure that justice prevails.

"MyAQSA Foundation is dedicated to delivering this report and evidence to the ICC Prosecutor's office for immediate action.

"We have prepared an extensive dossier, complemented by the latest evidence detailing the war crimes committed by the Israeli Zionist Regime against the Palestinian population.

"Our legal team will personally meet with the ICC Prosecutor in The Hague, the Netherlands, in the near future to provide the prepared dossier and evidence with the hope of expediting actions against the tyranny of the Israeli Zionist Regime," he said at the press conference held at the Palestine Embassy today.

He noted that the MyAQSA's legal team is expected to submit and present the full evidence to the ICC by the end of this month.

Since Oct 7, Israel has killed more than 9,000 Palestinians, predominantly women and children, and their claims of self-defence in countering Hamas have been challenged due to the alleged use of over 18,000 tonnes of bombs on Gaza, causing substantial casualties.

Lukman said MyAQSA has been dedicated to bringing the Israeli Zionist Regime's actions before the ICC since 2018.

"Our persistence and dedication have resulted in the official initiation of an investigation into war crimes and crimes against humanity by Israel against Palestine.

"The ICC Prosecutor also began an official investigation, marking a significant milestone in the pursuit of justice on February 9, 2021.

"The massacres committed by the Israeli Zionist Regime are blatant crimes of genocide, crimes against humanity, and war crimes, which are within the ICC's jurisdiction under the Rome Statute," he said.

In 2020, MyAQSA was recognised as the 'amicus curiae' (friend of the court) to the ICC as part of efforts to help establish the court's jurisdiction over possible action against Israel's war crimes in Palestine.

This will enable MyAQSA to assist the ICC by submitting the argument that Palestine is a sovereign country.

With that, the ICC can have absolute jurisdiction to investigate and subsequently prosecute Israel over the crimes it has committed.

MyAQSA also calls for Muslim countries to immediately cease all forms of business and trade with Israel as a form of protest against its actions.

"Muslim countries that currently maintain diplomatic relations with Israel are urged to sever those relations and close Israeli embassies within their respective countries," he said.
