Cabinet to discuss High Court's annulment of RM66,000 award to ex-US Embassy guard

PUTRAJAYA: The High Court's decision to annul the RM66,000 award granted by the Industrial Court to a former security guard at the United States Embassy here will be discussed at the weekly cabinet meeting tomorrow.

Human Resources Minister Steven Sim said he would raise the issue during the meeting, considering it is a serious matter. He said the ministry will also scrutinise the court's decision.

"We are monitoring it closely and discussing it with the ministry's legal officers. However, we will need to examine the grounds of judgment first, which have yet to be released.

"Subsequently, the ministry's legal officers will discuss with the Attorney General's Chambers to determine the necessary measures," he told a press conference after the pre-launch of the 2024 Labour Day and Pocket Talks Series 1 Programme today.

Yesterday, the High Court allowed a judicial review application filed by the United States government to overturn an RM66,000 compensation awarded by the Industrial Court to a former security guard at its embassy here for wrongful dismissal.

Judge Datuk Amarjeet Singh, in allowing the application, stated that the court found that the applicant (the US government) and its embassy have immunity and are protected from the jurisdiction of the Industrial Court over the claim by former security guard L. Subramaniam under Section 20 (3) of the Industrial Relations Act 1967.

The decision, which was delivered via email, also saw Subramaniam having to pay costs of RM8,000.

Earlier in his speech, Sim said Prime Minister Datuk Seri Anwar Ibrahim will launch the National Human Resources Policy Framework, the first for Malaysia, during the Labour Day celebration on May 1.

"This framework will serve as a policy guideline for the ministry and the government in general to implement human capital development programmes in the country."

He said the event, to be held at Putrajaya International Convention Centre (PICC), will see 12 awards being presented to workers, employers, unions, media, and contingents.

The celebration with the theme 'Pekerja Kesuma Bangsa' will be attended by more than 3,000 workers from unions, statutory bodies, and public and private sectors.
