Khairuddin files suit against ex-IGP, AG, 6 others over his wrongful arrest under Sosma in 2015

KUALA LUMPUR: Former Umno leader Datuk Seri Khairuddin Abu Hassan has filed a suit against former Inspector-General of Police Tan Sri Khalid Abu Bakar, Attorney-General Tan Sri Mohamed Apandi Ali and six others seeking a total of RM8.8 million in damages over his wrongful arrest under the Security Offences (Special Measures) Act 2012 (Sosma) three years ago.

He filed the legal action at the High Court registry here today through Messrs Haniff Khatri.

Khairuddin, who is PKR candidate for the Jasin parliamentary constituency in Melaka, also named ASP Wan Aeidil Wan Abdullah and ASP C.Muniady, who were investigating officers from the Classification of Criminal Investigation Unit, Bukit Aman Criminal Investigation Department, Dang Wangi district deputy police chief Superintendent Habibi Majinji, deputy public prosecutors Datuk Masri Mohd Daud and Awang Armadajaya Awang Mahmud, and the government as defendants.

In his statement of claim, Khairuddin stated that on Sept 18, 2015, he was detained by police for investigation under Section 124C of the Penal Code.

On Sept 23 the same year, after the court ordered his release, he was rearrested under Sosma and charged at the magistrate’s court here under Section 124L with attempting to sabotage the nation’s economy.

However, on May 12, 2017, the prosecution decided to withdraw the charge against him and he was subsequently acquitted and discharged.

Khairuddin claimed that his arrest under Sosma was an abuse of the law as it had caused him to be wrongfully detained at the Sungai Buloh prison for 60 days.

He also claimed that the prosecution had malicious intention against him which had caused his reputation and image to be tarnished.

He is seeking general, special, exemplary and aggravated damages as well as costs and other relief deemed fit by the court.
