Up to police whether to call former AG: Nur Jazlan

KUALA LUMPUR: The investigation into an alleged charge sheet against Prime Minister Datuk Seri Najib Razak is still ongoing, the Dewan Rakyat was told today.

Deputy Home Minister Datuk Nur Jazlan Mohamed said as such, it was up to the police whether to call former Attorney-General Tan Sri Abdul Gani Patail with regards to the investigation.

The Malaysian Anti-Corruption Commission (MACC) had previously denied the existence of the draft charge sheet against Najib.

However, the late deputy public prosecutor Datuk Anthony Kevin Morais brother, Charles, had recently alleged in a Statutory Declaration that his older brother’s murder was linked to a charge sheet the former was preparing against a “high-ranking government official”.

"It is up to the police (whether to call Gani), I can't say it here. You as a lawyer should know that whatever said outside an ongoing investigation could distort the process. The process is still in investigation by the police. If there is clear evidence, then only will the case be brought to court for charge," he said while winding up 2016 Budget in Committee stage.

Gobind Singh Deo (DAP-Puchong) earlier asked if the investigation could be compromised due to conflict of interest as the prime minister was still in office.

Datuk Seri Abdul Azeez Abdul Rahim (BN-Baling) then interjected and said it was merely an accusation (about the charge sheet) and that as a lawyer, Gobind should know better.

"You know there are three pillars making up the executive, legislature, and judiciary system (court). So, how can you say the prime minister can influence the investigation and judiciary? There are clear separation of laws.

"The procedure is (that) when there are allegations, the police will carry out investigations before submitting the paper to the Attorney General who would then decide and later (carry out) court proceedings. As of now, the matter is still in the police investigation stage," Jazlan said .
