5 men get 5 days jail for assaulting, pouring scalding hot water on man

SHAH ALAM: Five men who gang-assaulted a man and poured hot water on his body, causing third degree burns, were today sentenced to five days’ jail and a RM6,000 fine in default of 12 months’ jail, for rioting.

The five – Adlan Ramli, 37; Mohd Fiqri Abd Halim, 25; Shahbani Basia, 33; Azwan Kamar, 35; and Erwan Abd Ghani, 37, pleaded “guilty” to the offence when the charge was read before magistrate Raja Noor Adila Raja Mahyaldin here today.

Noor Adila also ordered their jail sentence to run from the date of their arrest on May 20.

Meanwhile, three other accused – Mohd Ridzwan Mahmod, 33; Abu Zar Md Yatim, 49; and Mohd Rizal Mahmod, 40, claimed trial to the charge.

The eight were charged under Section 148 of the Penal Code for rioting, which carries a sentence of five years’ imprisonment or a fine, or both, upon conviction.

According to the facts of the case, the victim, Mohamad Norariff Ab Latiff, was allegedly beaten by a group of men before being deliberately scalded with hot water at Kampung Paya Jaras in Sungai Buloh at about 1am on May 20.

Norariff, 25, sustained extensive and severe burns to his face, back, left shoulder and neck.

His father, who received a distress call, rushed to the scene and found Norariff lying on the ground surrounded by passers-by.

It is believed that he was attacked by 10 to 15 men for allegedly having an affair with a woman undergoing divorce proceedings.

Deputy public prosecutor Amira Haziqah Zulkifli, while prosecuting, asked for apt punishment to be handed down to the three men.

“The sentence should serve as a deterrent to others against committing the same offence,” she said.

However, lawyer Nurul Ikrimah Mohd Raya, who represented all eight men, pleaded for a lenient sentence and bail for her clients.

The court set bail at RM5,000 with one surety for each of the three men and fixed June 6 for mention.
