Court postpones re-mention of Sandakan terror trio case to Nov

SANDAKAN: The sessions court here today fixed Nov 22 to re-mention the case of three men accused of planning to fight alongside terrorists in the southern Philippines in June.

Judge Ummu Kalthom Abd Samad ordered the case’s postponement as the prosecutors have yet to obtain the full report from cyber security, which is a prerequisite for the case to be transferred to the Kota Kinabalu High Court.

Local man Nor Azmi Zahyi, 48; and Indonesians Faisal Abu Bakar, 24 and Ali Mirson, 36, were charged under Section 130J of the Penal Code (Act 574).

Nor Azmi and Faisal allegedly committed the offence on June 15 at 12.20pm in front of a boutique here.

Faisal was also charged under Section 6 (1) of the Corrosives, Explosives and Dangerous Weapons Act 1968 (Act 357) for possessing three 27.3cm knives at the same place and time.

On the same date, Ali had attempted to fly to the Philippines from Sandakan airport at about 6.15pm.

He was also charged under Section 130J B (1)(a) of the Penal Code for having Islamic State (IS)-related material in his phone.

Mohd Faisal Mohd Nor represented Deputy Public Prosecutor Mohamad Mustaffa P Kunyalam.

Faisal and Ali were represented by counsel Rowiena Rashid, while Nor Azmi was unrepresented.
