Housewife escapes jail time for criminal intimidation

ALOR SETAR: A housewife, who made a murder threat against a woman two years ago, escaped a five-day jail time despite being found guilty.

High Court judge Chan Jit Li made the decision after accepting the plea made by R Samundiswari, 34, but retain the RM8,000 fine imposed by Kulim magistrate’s court in February.

Based on the charge sheet, the woman was charged with criminally intimidating B Sri Pracha Nanthini, 39, at a polyclinic belonging to Pracha’s husband at Jalan Tunku Abidah in Kulim.

The incident occurred at 3.40pm on June 4, 2016 after the housewife's demand for treatment to be given not in accordance to the sequence of numbers was denied.

She was charged under Section 506 of the Penal Code which carries a maximum of two years in jail or fine, or both, upon conviction.

Jit Li made the decision to dismiss the jail sentence after hearing the arguments from the defendant’s lawyer RSN Mayer and deputy public prosecutor Syazwani Syed Husin.

Syazwani argued that the sentence was too lenient while Rayer pleaded for leniency as the incident only involved verbal altercation and no one was hurt.

NSTP had reported in February that a housewife was sentenced to five days in jail and fined RM8,000 by the Kulim magistrate’s court for threatening a woman.

Magistrate R Manomani meted the decision at the end of the defence case, after the court found that the accused had failed to raise reasonable doubt to the charge made against her
