Drug case involving brother of federal minister set for trial

KOTA KINABALU: A drug trafficking case involving the brother of a federal minister, Tan Sri Noh Omar, will be heard on Dec 5-7, this year.

High Court judge Wong Siong Tung fixed the trial dates for Mohd Jusnaidi Omar, 50, when the case was mentioned today.

Jusnaidi had on Sept 30 last year pleaded not guilty to trafficking in 82.71g of syabu at the Kota Kinabalu International Airport's police station at 8.30pm on Nov 27, 2019.

He was charged under Section 39B(1)(a) of the Dangerous Drugs Act 1995, punishable under Section 39B(2) of the same, which provides for the death sentence or life imprisonment, and if not sentenced to death, the accused could be punished with whipping of no less than 15 strokes, upon conviction.

This is the second time Jusnaidi was charged with drug trafficking.

Before this, he was acquitted and discharged by the High Court here on a charge of trafficking in 1.011kg of cannabis at the Low Cost Carrier Terminal in Tanjung Aru at 10am on May 20, 2007.

Several years later on Sept 1, 2016, Jusnaidi was sentenced to five years' imprisonment by the Sessions Court for voluntarily causing hurt by a dangerous weapon, under Section 324 of the Penal Code.

He was found guilty of shooting a mechanic with a pistol at 5pm on May 6, 2015, at premises along Jalan Tuaran bypass.

In Jusnaidi's latest drug case, he was represented by counsel Zahir Shah. Deputy public prosecutor Mohammed Ali Imran prosecuted.

Jusnaidi is currently under remand as the charge against him has no provision for bail.
