Former soldier failed to challenge dishonourable discharge order

KUALA LUMPUR: A former army sergeant failed to challenge his dishonourable discharge which took effect after he refused to undergo Covid-19 vaccination.

High Court Judge Datuk Ahmad Kamal Md Shahid today dismissed a judicial review filed by Wan Ramli Wan Seman against the Armed Forces and the government.

Ahmad Kamal in his decision said the decision made by the respondents was within the law.

Wan Ramli who was with the Royal Malay Regiment's 24th battalion based at the Rasah Camp in Negri Sembilan is seeking a court declaration that his early termination in August last year is null and void.

He was scheduled to be discharged on Jan 20 this year.

He was terminated over four alleged offences under the Armed Forces Act 1972. As a result, Wan Ramli lost his right to receive a pension.

Wan Ramli claims his rights as a citizen and member of the armed forces under Articles 5(1) and 8(1) of the Federal Constitution have been violated.

He said he had lost his right to receive a pension under Article 147 of the constitution, which was a proprietary right protected by Article 13(1).
