Cops freed of bribery charges

KOTA KINABALU: Two policemen were freed by the Special Corruption Court here on a bribery charge involving RM300.

Lance Corporal Mohd Faizal Nor Ahmad, 34, and Corporal Alzohari Md Suhaili, 47, were discharged and acquitted by Sessions Court judge Jason Juga without calling them to enter defence.

In his judgment, the judge, among others, held that the prosecution had failed to establish a prima facie case against the duo.

Mohd Faizal and Alzohari were jointly accused of accepting the bribe from an undocumented man as an inducement to not take action against the man for not having valid documentation.

According to the charge sheet, Mohd Faizal and Alzohari were accused of committing the offence in front of the Oceanus Waterfront Mall building here, between 1pm and 3.50pm on July 4, 2016.

They were charged with committing the offence under Section 17(a) of the Malaysian Anti-Corruption Commission (MACC) Act 2009, which is punishable under Section 24(1) of the same Act provides a jail term of up to 20 years and a fine five times the bribe amount upon conviction.

A total of 14 witnesses were called during the trial.

MACC prosecuting officer Norsham Saharom appeared for the prosecution while both accused were represented by counsel Nurshalilah Fauzan Mailin.
