Two MACC officers charged with gang robbery involving RM952,690

KUALA LUMPUR: Two Malaysian Anti-Corruption Commission (MACC) officers and a former colleague were charged at the Sessions Court today for a gang robbery on a foreign businessman three years ago.

Muhamad Haffiz Mohd Radzi,33, an investigating officer and Mohd Fahmee Mohamad Nor,41, an officer with the MACC Academy were jointly charged before Sessions Court Judge Izralizam Sanusi.

Another ex-anti-graft officer Azwan Asli, 38, was charged before Judge Siti Aminah Ghazali.

The trio had allegedly robbed Kun Gao of his belongings which were RM952,690 in cash, 1,225 Chinese Yuan, a silver baggage and a black LV bag at Ritz Carlton Residence, Jalan Ampang at about 12pm on Dec 10, 2021.

They claimed trial to the charges framed under Section 395 of the Penal Code which carries a maximum of 20 years jail and whipping upon conviction.

Deputy public prosecutor Izalina Abdullah prosecuted both cases.

Before Judge Izralizam, she said it was a non-bailable offence but left it to the court's discretion.

She proposed bail of RM30,000 each with one surety and as additional conditions, both the accused have to report to the nearest police station to their homes monthly and for their passports to be surrendered to the court.

Defence counsels S. Ravichandaran and R. Vikraman, who appeared for Muhamad Haffiz and Mohd Fahmee respectively, asked for a lower bail as it was meant to ensure their attendance in court.

Ravichandaran asked for the compassion of the court as his client earns RM3,000 a month and the proposed bail was 10 times more.

"My client is innocent until proven guilty. The bail sum cannot be too high or else he would not be able to pay and have to be in jail. That cannot happen. I ask bail to be set at RM5,000," he said.

Vikraman said his client has a RM4,500 monthly salary including allowance and suffers from low blood pressure.

"Moreover, there were no losses in this case as the investigating officers have recovered the whole sum.

"We ask the bail to be minimum. My client has a bailor friend who is a technician and he can prepare RM4,000 for bail," he added.

Judge Izralizam allowed bail of RM12,000 with one surety to Muhamad Haffiz and Mohd Fahmee.

He also ordered them to report to the nearest police station monthly, surrender their passport to the court and not to harass prosecution witnesses.

Meanwhile, Judge Siti Aminah allowed bail of RM10,000 with one surety to Azwan,who was represented by Vikraman.

The cases involving the trio will be mentioned before Judge Izralizam on Feb 5.

On Dec 13,2021, Berita Harian reported that two individuals including a MACC officer were arrested for alleged gang robbery at a home in Jalan Ampang.

The trio had introduced themselves as enforcement officers before breaking into the premises of a businessman in his 50s.
