Four friends charged with raping 12-year-old girl

KUALA LUMPUR: Four male youths were each charged at the Sessions Court here today with one count of raping a 12-year-old girl on Dec 24 last year.

Wan Nur Aiqal Asraff Ahmad Fazli,19,Muhammad Daniel Haiqal Mohd Azmi,19, Ahmad Zakry Ahmad Zaki,19 and Muhammad Daniel Roszali, 22, pleaded not guilty after the charges were read before Judge Mohd Kafli Che Ali.

They were accused of raping the girl at a flat unit in Cheras between 2am and 3.40am on Dec 24.

The charges were framed under Section 376(1) of the Penal Code which carries jail terms of up to 20 years and whipping.

Deputy public prosecutor Noorhani Muhmmed (correct) Ayub urged the court not to offer bail due to the severity of the offence as it involved a child.

Defence counsel Nasrul Hadi Mat Saad, who represented the quartet, pleaded to the court to use its discretion to offer bail under Section 388 of the Criminal Procedure Code.

He urged the court to set bail at RM3,000 each.

He said Wan Nur Aiqal, Muhammad Daniel Haiqal and Ahmad Zakry were SPM leavers awaiting offers to further their studies while Muhammad Daniel worked as an e-hailing driver.

Nasrul Hadi said his young clients should be given bail to deter them from mixing with detainees in jail and being exposed to negative elements.

Noorhani, however, stood her ground and objected, saying all of the accused should not be offered bail.

Judge Mohd Kafli set bail at RM8,000 with one surety for each accused.

As additional conditions, he ruled that all of the accused must not harass the victim until the case was disposed of.

He also ordered them to report to the nearest police station monthly.

Feb 14 was set for mention.
