Cops call up Tony Pua over 'defamatory' Facebook video

KUALA LUMPUR: Police will call up Petaling Jaya Utara MP Tony Pua Kiam Wee over a video posted on his Facebook page which allegedly contained defamatory remarks against Prime Minister Datuk Seri Najib Razak.

It is learnt that Pua has been asked to be present himself at the federal police headquarters in Bukit Aman to have his statement recorded at 11am tomorrow.

The 2-minute, 21-second live video was uploaded on his Facebook page related on Pas' Private Member's Bill to amend the Shariah Courts (Criminal Jurisdiction) Act 1965 (Act 355), also known as RUU355 on April 6.

It was reported that Najib has filed the legal action in his personal capacity through Messrs Hafarizam Wan & Aisha Mubarak at the High Court registry here on Friday, naming Pua as the defendant.

In his statement of claim, Najib claimed that on April 6, Pua made a statement at the Parliament building area, which was recorded.

He claimed that the statement in the live video was specifically directed at him and that there was malice in the defendant's (Pua) libelous statement, and that it was made with bad intention to defame him (Najib).

Najib also claimed that the defendant had slandered him under Section 5 of the Defamation Act 1957 against the position held by the plaintiff (Najib).

He is seeking for general, aggravated and exemplary damages, as well as an injunction to prevent the defendant – either by himself or any of his agents, in whatever way – from publishing further statements that are defamatory in nature.
