Family of murdered Dutch model seeks assistance from Anwar

KUALA LUMPUR: The family of Ivana Smit, a Dutch model who died after falling from a condominium unit in December 2017, has asked Prime Minister Datuk Seri Anwar Ibrahim to help them get justice.

Sébas Diekstra, a lawyer representing the family, said they had not received any updates on the case in the last four years.

"Since the incident, the Smit family has been working hard to find justice for the late Ivana. However, until now, the answer they are looking for has not yet been answered. Among the question marks until now: How did Ivana die? Is a third party involved in his death?" Diekstra said in a post on X, formerly Twitter.

Diekstra said the Kuala Lumpur High Court had ordered the police to re-investigate this case as a murder after a civil case was filed against the police and the Malaysian government.

"However, since the order in 2019, the family has not yet received any updates about the case. Four years have passed.

"As the lawyer of the Smit family, I humbly appeal to the Prime Minister of Malaysia @anwaribrahim to instruct the authorities to do something. PM Anwar's personal involvement is important to get justice for Ivana and her family," said Diekstra.

Smit was found dead on Dec 7, 2017 due to a fall from height at CapSquare Residences at Jalan Dang Wangi.

On March 8, the Coroner Court ruled the death a "misadventure" as there was no clear evidence of any criminal element, nor involvement of any individual in the case.

However, on Nov 22, 2019, the High Court set aside Smit's inquest decision of her death as the result of "misadventure", to death by person or persons known or unknown.

Justice Collin Lawrence Sequerah also directed the Attorney General's Chambers to order the police to investigate the cause of her death.

He said the inquest decision, made by coroner Mahyon Talib, was inconsistent with her findings, particularly involving witness Dutch pathologist Dr Frank Van de Goot.
