MELAKA: A 35-year-old man with learning disability was charged at the Sessions Court today with sexually assaulting an eight-year-old boy last Wednesday.
Muhammad Anill Asiff Zamaludin pleaded not guilty to the charge read to him before Judge Norma Ismail.
Muhammad Anill was alleged to have committed physical sexual assault on a child by performing oral sex on the boy at a toilet in Balai Raya Taman Tambak Paya Permai about 6.30pm on Sept 13.
The charge was under Section 14(a) of the Sexual Offences Against Children Act 2017 which provides for 20 years' jail and whipping, if convicted.
Deputy Public Prosecutor Siti Ruvinna Mohd Rawi urged the court not to grant bail as the accused might disturb the main prosecution witness, as they both lived nearby.
Counsel M. Pusppa pleaded to the court to grant bail as her client has a disability.
"My client may be 35-years-old but he behave like a 10-year-old. Besides, he needs to be under the care of his family," she said.
Norma then set bail at RM15,000 with one surety and fixed mention on Oct 19.
She also warned the accused to stay away from the victim.
