Primary school music teacher charged with sexual assault on 10-year-old pupil

IPOH: A music teacher of a primary school was charged at the Sessions Court here today with two counts of physical sexual assault on his 10-year-old pupil between June and July this year.

The accused, Mohamad Nazmi Mohamed Nazri however pleaded not guilty when the charges were read to him before Judge, Ainon Shahrin Mohamad.

For the first count, the 39-year-old teacher was accused of touching the pupil's private part for sexual purposes. For the second count, the teacher was accused of placing his private part on the victim's buttock for sexual purposes.

Both offences were allegedly committed at a music room of a primary school in Jalan Pegoh, Lorong Pegoh 4, Taman Pengkalan Jaya here between June and July at 9.45am and 10.30am, respectively.

The offence falls under Section 14(a) of the Sexual Offences Against Children Act 2017 (Act 792) which carries a maximum of 20 years imprisonment and whipping and placed under police supervision for not less than one year and not more than three years as under Section 295(1A) of the Criminal Procedure Code.

Deputy Public Prosecutor Qurratu'Aini Khalifah while prosecuting asked no bail be offered to the accused as the offence was a sexual case and he would not disturb the victim.

However, during mitigation, the accused who was represented by a lawyer, Syahrul Nizam Mohd Rabi requested a lower bail as his client is married and needs to support his wife and three children aged between three and nine years old.

Syahrul Nizam also added that the accused also suffers from anaemia and heart problems.

The court then set bail at RM5,000 with one surety and fixed Dec 20 for mention.
