Duo charged with assaulting younger brothers in family feud

KUALA LUMPUR: Two siblings were charged at two magistrate's courts here today with hurting their younger brothers during a family feud, here, last week.

Mohd Firdhaus Halim, 33, and Fathullah Halim, 30, pleaded not guilty when the charges were read to them before magistrates Haslinda A. Raof and Mohamad Firdaus Sadina Ali.

At the first court, the duo were slapped with two counts of voluntarily causing grievous hurt to their brothers Muhammad Hafeez Halim, 20, and Hilal Halim, 25, near their house at Jalan E, Kampung Pandan Dalam at 9.30pm on Feb 20.

Deputy Public Prosecutor Raihanah Abdul Razak asked the court to set RM4,000 bail for each of them.

In pleading for minimum bail, the accused, who were unrepresented, said they did not have stable incomes and that the reason they hit their brothers was because they were "rebellious to their parents".

“They made our father cried… I did that to teach them a lesson,” Fathullah said.

Haslinda fixed bails at RM2,500 for the duo respectively while fixing April 2 for mention.

The duo, who worked as night market traders, also faced a second similar charge in a separate magistrate’s court.

They were slapped with two counts each for hurting the same victims at the same place and time.

Firdaus set bail at RM2,000 for the accused and fixed March 26 for mention.

The offences fall under Section 323 of the Penal Code read together with Section 34 of the same Code which carries maximum one year in jail or RM2,000 fine or both upon conviction.

Meanwhile, Firdhaus also pleaded not guilty when he was charged with hurting Hafeez under Section 324 of the Penal Code.

He faces maximum jail sentence of up to three years or fine or caning, or any two of the penalties, upon conviction.

Haslinda set bail at RM3,000 and fixed April 2 for mention.
